License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "Purchaser") and the owner of The Archetype Process ("TAP"). By purchasing, downloading, installing, or using any TAP Product, you agree to these terms. If you do not agree, do not install or use the Products.

1. Products

"Products" means everything TAP sells or provides, in any format and on any platform, including camera profiles, presets, Capture One styles, ICC profiles, LUTs, actions, scripts, plugins, software, templates, and any updates to them.

2. Ownership

TAP owns the Products and all intellectual property in them, including the color and tonal data they contain. The Products are licensed to you, not sold. No ownership is transferred to you, and you must not claim any Product as your own. The Archetype Process name and logo are trademarks of TAP.

3. Your License

TAP grants you a personal, non-exclusive, non-transferable license to install and use the Products on up to three (3) computers that you own or control. If the Purchaser is a business, the license covers that business's own employees editing that business's work, on up to three (3) computers in total. Each additional person or computer outside these limits requires its own license.

4. What You May Do

You may use the Products to edit your own photographs and your clients' photographs, for personal or commercial work. The images you create are yours.

5. What You May Not Do

You may not, and may not help anyone else to:

  • Sell, share, give away, rent, sub-license, upload, or otherwise distribute any Product, or install it on computers beyond your license.
  • Measure, sample, extract, convert, or recreate any Product, or the color and tonal data in it, in any form or format. This includes creating LUTs, profiles, presets, styles, or other files from a Product, from test charts or images processed with a Product, or by comparing images before and after a Product is applied.
  • Modify, combine, or repackage any Product and distribute or sell the result.
  • Use any Product, or images processed with a Product, to train, test, or improve any machine learning or artificial intelligence model or system, except for your own personal editing of your own photographs.
  • Use any Product to create or support any product or service that competes with TAP.
  • Remove or alter any copyright notice, name, or license key protection in a Product.

6. Termination

This license ends automatically if you break any of these terms. If it ends, you must stop using the Products and delete every copy. TAP may pursue all remedies available under law, including damages and injunctive relief.

7. Refunds

Because the Products are digital downloads, all sales are final, and TAP does not offer refunds, returns, or exchanges, except where the law requires otherwise.

8. Disclaimer Of Warranties

The Products and the TAP website are provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law.

9. Limitation Of Liability

To the fullest extent permitted by law, TAP is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, data, or images, arising from your use of the Products or the TAP website. TAP's total liability will not exceed the amount you paid for the Product.

10. General

This agreement is governed by the laws of the State of Michigan, USA, without regard to its conflict of law rules. If any part of this agreement is found unenforceable, the rest remains in effect. This is the entire agreement between you and TAP about the Products. TAP may update these terms for future versions and purchases.
